Terms and Conditions
As a member, you agree to all terms and conditions of membership.
Operations
The Friends of the Children Wine Club is operated by Specialty Wines NW, a licensed Oregon winery, under agreement with The Friends of the Children PDX. Credit card charges will appear as “Specialty Wines NW.”
Who Can Join
By becoming a member, you verify that you or the recipient of the club is at least 21 years of age. Due to system constraints, we are only able to have one name and one corresponding email on the membership; benefits are non-transferable. The Friends of the Children PDX Wine Club is available only to those with an Oregon shipping address at this time.
Notifications
You will receive an email at least one week prior to each club shipment noting important dates and details of your shipment. It is your responsibility as the member to notify The Zoo Foundation Wine Club of any changes to credit card or billing/shipping address prior to the billing. Unfortunately, we are unable to make any changes after billing.
Billing
The club releases will be charged to the credit card on file four times per year (Fall, Winter, Spring, Summer). It is your obligation to update your credit card information online or by phone 503-850-7755 or email the billing date. In addition, any address changes must be made in writing to support@Friendspdxwineclub.com or phone at least 5 days prior to this billing. Club wine purchases and shipping fees are non-refundable once they have been processed.
Shipping
We have negotiated the lowest shipping costs available and are pleased to pass the savings on to our members. All wine shipments must be signed for by a person at least 21 years of age. A daytime delivery address, preferably a business address, is requested. Shipments are handled by FedEx and cannot be delivered to PO, FPO, APO or IPO boxes. Returned or refused shipments will incur additional fees. The Friends of the Children PDX Wine Club is not responsible for shipping charges incurred due to misdirected or returned shipments or changes made after the deadline. If a club shipment is returned for an incorrect address or three failed delivery attempts, you will be responsible for the additional cost of reshipping.
Shipping Conditions
During times of inclement weather, extreme heat, or extreme cold, The Friends of the Children PDX Wine Club reserves the right to delay shipments until conditions improve. Please be advised that The Friends of the Children PDX Wine Club is not responsible for items damaged due to extreme weather conditions.
Winery Pick Up We do not offer this service now but hope to have a local pickup option available soon.
Substitutions While not every person likes every wine, every wine we choose for The Friends of the Children PDX Wine Club is of top quality. We choose only wines that are known throughout the Oregon wine industry for their high standards and delicious character. Wine club substitutions are politely declined.
Additional Wines
You have the option to purchase additional bottles of the club wine selections that will ship at the same time as your wine club wines, or to buy other wines that may be available to include in your wine club shipment.
Holds and Cancellations You may place your membership “on hold” or cancel your membership with a written notice to support@friendspdxwineclub.com at least 5 days prior to a club billing date. All wine purchases and shipping fees are non-refundable after processing.
Exchanges for Damaged Bottles
You must contact Friends of the Children PDX Wine Club at 503-850-7755 or support@zoowineclub.com within seventy-two hours of delivery to report broken or otherwise damaged products to request an exchange.
Reorders
Wine offers, including Wine Club Selections, will generally be available for a fixed period of time, after which the offer is finished. While we don't routinely keep wines we've featured in stock, we do occasionally have extra bottles available. If you love a wine that was included with your shipment, send us an email at support@friendspdxwineclub.com and we'll let you know if we have some available.
Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or related to these Terms and Conditions, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Oregon without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms and Conditions or the Friends of the Children PDX Wine Club site shall be instituted exclusively in the federal or state courts located in Portland, Oregon. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Waiver and Severability
No waiver of these Terms and Conditions by Friends of the Children PDX Wine Club shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Friends of the Children PDX Wine Club to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
This contract is fully integrated. Any item not specifically mentioned herein is not a part of the agreement.
Information Collection and Use
Friends of the Children PDX Wine Club is the sole owner of the information collected on this site. We will not sell, share, or rent customer information to any other organization. Friends of the Children PDX Wine Club order forms request data from customers including contact information (such as name, email address, shipping address, and phone number) and financial information (such as credit card number, expiration date, security code, billing address, and billing phone number). This information is used for billing purposes to verify that the customer is of legal drinking age, and for shipping purposes only. If we encounter difficulty when processing an order, we will use this information to contact the customer. If at any time you would like to change or update information in your account, you may do so on the site or by contacting us 503-850-7755 or email support@Friendspdxwineclub.com
Credit Card Processing and Security
Purchasing wine club products from Friends of the Children PDX Wine Club is absolutely safe and secure. In an effort to protect your privacy, Friends of the Children PDX Wine Club uses the latest technology to keep your personal information safe. Credit card transactions are handled by an accredited third-party financial institution, which receives credit card and other personal information for verification purposes and to process transactions.
Legal Disclaimers
Friends of the Children PDX Wine Club reserves the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process. Friends of the Children PDX Wine Club is not responsible and shall not be liable for any injury or damage caused by, or arising from, the consumption of the merchandise sold to its customers.
Modifications
We may, at any time, revise or modify these Terms Conditions or impose new conditions for use of the Friends of the Children PDX Wine Club sites. Such changes shall be effective immediately upon notice to you, which may be given by any means including, without limitation, posting on the Friends of the Children PDX Wine Club site. Any use of the Friends of the Children PDX Wine Club site or receipt of a Friends of the Children PDX Wine Club shipment by you after such notice shall be deemed to constitute acceptance of such changes.
